Consent to Electronic Communications

By submitting forms, accessing borrower-facing services, or interacting with Palermo Financial Group electronically, you consent to receive communications from Palermo in electronic form. You acknowledge that electronic communications may include email confirmations, electronic notices, requests for information, and documents related to your loan or borrower request.

Types of Communications

Electronic communications may include, but are not limited to:

• Confirmation emails for submitted forms
• Status updates on loan inquiries, draw requests, payoff requests, or ACH authorizations
• Requests for additional documentation or information
• Notifications regarding loan servicing, payments, or account changes
• Documents related to your loan, including payoff statements, draw approvals, or payment confirmations
• Legal notices and disclosures

Electronic communications may also include SMS or text messages to the phone number you provided where permitted by law and, for marketing messages where required, where you have separately provided consent. Consent to marketing calls or marketing text messages is not a condition of obtaining credit.

Electronic Signatures and Submissions

You acknowledge and agree that typed names, checked boxes, electronic form submissions, and uploaded documents may be treated as electronic signatures, acknowledgments, or authorizations to the fullest extent permitted by applicable law. By submitting forms electronically, you are providing your consent and authorization in electronic form.

Electronic signatures and submissions are governed by the federal Electronic Signatures in Global and National Commerce Act, commonly known as the E-SIGN Act, and the Florida Electronic Transaction Act, Fla. Stat. §668.50.

Uploaded Documents

Uploaded documents, including photos, scans, PDFs, and other files, are treated as authorized submissions and may be used as evidence of your intent, authorization, or agreement. You represent that you have the right to submit uploaded documents and that you authorize their use for processing your request.

Hardware and Software Requirements

To access, view, and retain electronic communications, you must have access to a device with an internet connection, a current web browser, a valid email account, and software or browser functionality capable of viewing and saving PDF files or other standard electronic documents. You are responsible for maintaining the equipment, software, internet access, and email access necessary to receive and retain electronic communications from us.

Paper Copies

You may request paper copies of electronic communications by contacting Palermo Financial Group at the address or phone number listed below. However, requesting paper copies may delay processing of your request.

Withdrawal of Consent

You may withdraw your consent to electronic communications at any time by contacting Palermo in writing, by email, or by phone. However, withdrawal of consent may affect our ability to process certain requests electronically or in a timely manner.

Effect of Withdrawal

If you withdraw your consent to electronic communications, Palermo may require you to submit forms and documents in paper form, which may result in delays in processing your request. Some forms and processes may not be available in paper form, in which case you may not be able to submit certain requests.

Updating Contact Information

It is your responsibility to maintain current and accurate contact information, including your email address and phone number. If your contact information changes, please update it by contacting Palermo directly. Palermo is not responsible for failures to deliver electronic communications if your contact information is incorrect or out of date.
